In February 2019 Greenway Health agreed to pay $57.25 million to settle False Claims Act allegations over its Prime Suite EHR. DOJ alleged that Greenway obtained 2014 Edition certification by hiding that the product lacked required standardized clinical terminology, and that it modified its test-run software to deceive the certifying body. DOJ also alleged that Greenway knew an earlier version miscalculated clinical-summary rates, which caused its users (physician practices) to falsely attest to qualifying for federal incentive payments, and that it paid clients to recommend the product. These are allegations with no determination of liability. The case shows a vendor defect turning into the customer practice's own attestation problem.

Data sharing

Who holds your data. Data chain: Greenway Health, then Vista Equity Partners (private equity; majority owner) (parent), then EHR vendor layer. See cross-cutting finding 16: THE EHR LAYER — THE COMPANY HOLDING YOUR CHART IS ONE YOU NEVER SIGNED WITH.

Fees and billing

The 2019 CIA guaranteed fee-free data transfer for its five-year term (about 2019-2024). Greenway's customer contracts are not public, so whether that protection survived the CIA's expiry could not be determined. DOJ also alleged that Greenway paid customers to recommend Prime Suite.
